Scott Radcliffe represented a commercial property owner in a complex, high-stakes lease and insurance dispute arising from a catastrophic fire that rendered a medical office building temporarily unusable. After the tenant attempted to terminate its lease and refused to remit insurance proceeds designated for restoration of the property, the firm filed a lawsuit alleging breach of contract, breach of the implied covenant of good faith and fair dealing, and seeking declaratory relief regarding the parties’ respective rights under the lease. When the tenant continued withholding more than $2 million in insurance proceeds constituting additional rent under the lease, Alves Radcliffe also commenced a commercial unlawful detainer action seeking forfeiture of the tenancy. The unlawful detainer matter proceeded to the eve of trial before the parties reached a comprehensive settlement. The settlement reinstated the commercial lease, resolved all pending litigation, and required a total payment of $2,408,727.48 million to the landlord, securing an exceptional recovery while preserving the parties’ ongoing business relationship.
